PAYMENT OF RENTAL: In the event the rental price of any
portion thereof is given in payment in the form of a check and
said check is returned NSF, renter shall be obligated to pay, a
NSF free of $50.00, plus an additional $25.00 bank charge. In
the event payment is stopped on said check, Virginia Truck &
Trailer Sales, L.C. shall have the right to collect the amount
of said check, plus and equal amount of said check, plus and
equal amount in damage, plus attorney fees.
*CONDITION: The trailer must be brought back clean and in
the same condition when it was rented. You must note any
problems with the trailer before you remove it from premises, or
it is assumed that the trailer is in excellent condition. If the
renter fails to return the trailer clean, a clean-up charge of
$75.00 for a Bumper Pull and $125.00 for a Gooseneck shall be
due upon the return of the trailer.
DAMAGE: I assume all liability for the trailer, including
but not limited to: appropriate insurance, the towing, the
hauling, transportation, the operation thereof, and the theft
thereof. I understand that if the trailer is damaged, at the
option of Virginia Truck & Trailer Sales, L.C., I may be
required to either purchase the trailer or other specified item
rented at the following replacement value or be required to pay
all damages, cost of repairs, and lass of income during the
period of time the trailer is unavailable for rental due to the
damage. This includes tires.
TIRES: All of our trailers have new tires and we maintain
new condition tires on them. Virginia Truck & Trailer Sales,
L.C. has installed spare tires on all of its trailers. In the
event of a flat tire, the renter is responsible for changing the
tire and any road service cost one may inquire. The renter shall
be liable for half the replacement cost of any tire that is
damaged beyond repair, and this amount is due upon return of the
trailer equipment. The two major factors that cause blowouts
include; a.) too heavy load weight for the tires. This is
controlled by the renter, not Virginia Truck & Trailer Sales,
L.C.
ATTORNEY FEES: I understand that this agreement shall be
governed by, and constructed according to the law of the State
of Virginia, and accordingly. I submit to the jurisdiction of
the courts of the State of Virginia or any appropriate Justice
of the Peace Court or other small claims courts should legal
action be filed to enforce the terms of this agreement, it being
the intent of the partles that the courts shall be the
exclusive, venue for any such action. If an attorney is employed
to protect any right of Virginia Truck & Trailer Sales, L.C.
arising under this agreement, renter agrees to pay additionally
actual attorneys fees incurred by Virginia Truck & Trailer
Sales, L.C. and costs of collection and enforcement of this
agreement.
I ASSUME ALL LIABILITY AND RESPONSIBILITY FOR CONNECTION OF THE
TRAILER TO MY VEHICLE. Virginia Truck & Trailer Sales, L.C. does
not make any suggesstions or determination in regard to whether
or not the trailer, your hitch, the size ball, or your vehicle
ARE COMPATIBLE. As a RENTER, I determine that the trailer is to
my satisfaction, that it is safe to pull, and that all
components are acceptable, including any chains and blinders
holding equipment down. VIRGINIA TRUCK & TRAILER SALES, L.C.
ASSUMES NO LIABILITY OR RESPONSIBILITY ONCE THE TRAILER LEAVES
THE PROPERTY!
I have read the foregoing and understood its content, and to
hereby agree to the terms and conditions herein.
